These Terms and Conditions regulate the use of the service of the web domain https://bexiegroup.com/ and its subdomains (hereinafter, collectively“the Portal“) that BEXIE GROUP, S.L. makes available to Internet users . These Terms and Conditions (which may be modified from time to time by BEXIE GROUP) are applicable to all services available on-line, through any mobile device, by e-mail or by telephone.

By accessing, browsing and using our Portal, you agree that you have read, understood and agree to the Terms and Conditions shown below (including the section on privacy). The use of the Portal implies the condition of Portal User (hereinafter the “User“) and implies full and unreserved acceptance of each and every one of the provisions included in these Terms and Conditions in the version published by BEXIE GROUP at the very moment the User accesses the Portal. The trademarks, trade names or distinctive signs are owned by BEXIE GROUP or third parties, without it being understood that access to the Portal attributes any right over said trademarks, trade names and/or distinctive signs.

What kind of personal information does BEXIE GROUP use? BEXIE GROUP?

Each time you visit our Portal, we may collect certain information such as your IP address, the browser you are using and information about your computer’s operating system, browser version, language settings and the pages you have been shown. What are the User’s rights when providing us with personal data?

In case of not obtaining satisfaction in the exercise of your rights, you may file a complaint with the Spanish Data Protection Agency (Control Authority competent in this matter).

BEXIE GROUP makes available to Users the contact email rgpd@bexiegroup.com, so that they can revoke the consent given. In turn, BEXIE GROUP provides the email rgpd@bexiegroup.com for the exercise of the rights described above in relation to the protection of their personal data.

BEXIE GROUP declares that it complies with current regulations regarding data protection, in particular in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data; and in Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights as well as any other applicable regulations regarding Data Protection.

On behalf of our company we process the information you provide in order to provide the services described in our Terms and Conditions, available for consultation on the Portal “https://bexiegroup.com/” and, where appropriate, in the service contract signed with you, as well as to perform the billing, administrative, accounting and economic management.

The personal data provided will be kept for as long as the professional relationship is maintained or for the years necessary to comply with legal obligations. The data you provide to us will not be transferred to third parties, except in cases where there is a legal obligation or there is some other legitimacy provided for in the regulations, such as the execution of a contract with you or your consent.

BEXIE GROUP does not know the contents and services of the Linked Sites and therefore is not liable for damages caused by the unlawfulness, quality, unavailability, error and uselessness of the Linked Sites or any other damage not directly attributable to BEXIE GROUP.

Any photo/image uploaded by a User that does not comply with the above requirements will not be published and/or may be removed by BEXIE GROUP at any time and without prior notice.

5.4. Intellectual and industrial property rights

Unless otherwise indicated, the software required for our services or used in our Portal and the intellectual and industrial property rights (including the “copyrights”) are protected by copyright.copyrights“of the contents and information, as well as the material of our Portal belong to BEXIE GROUP. BEXIE GROUP.

BEXIE GROUP reserves exclusive ownership of all rights, title and interest in (all intellectual and industrial property rights in) (the appearance (including the infrastructure) of the Portal where the service is available, and you are not entitled to copy, compile, link to, publish, promote, sell, integrate, use, combine or use the content (including translations) or our brand without written permission from BEXIE GROUP.

10.1. Applicable Law

10.2. Miscellaneous

Any dispute arising from these Terms and Conditions and the services provided by BEXIE GROUP shall, at the consumer’s discretion, be referred exclusively to (i) the competent courts of the consumer’s place of domicile, or (ii) the competent courts in Oviedo, Principality of Asturias, Kingdom of Spain.

For all other parties using the Portal who are not consumers, these Terms and Conditions and the services provided by BEXIE GROUP shall be governed by and construed exclusively in accordance with the laws in force in the Kingdom of Spain and any dispute arising from these Terms and Conditions and the services provided by BEXIE GROUP shall be referred exclusively to the competent courts in Oviedo, Principado de Asturias, Kingdom of Spain.

In case of dispute over the content or interpretation of the Terms and Conditions, as well as in the event of conflicts, contradictions or discrepancies between this version and the other versions in other languages, the Spanish version of these Terms and Conditions prevails and is conclusive to the extent permitted by law. You may consult the Spanish version on our Portal (by selecting the language) or ask us in writing to send it to you.

If any provision of these Terms and Conditions is or becomes invalid or unenforceable, you will continue to be bound by all other such provisions. If this should occur, the invalid provision shall be enforced to the fullest extent permitted by applicable law and, to the extent possible, a similar effect to the invalid or non-binding provisions shall be accepted, in accordance with the content and subject matter of these Terms and Conditions.
